You can follow these two ways to eliminate the violation of rights caused by content on the Internet.
- Removing Content From Publication
Pursuant to Article 6/A of Law No. 5651, Access Providers Association (ESB) has the task of coordinating the implementation the decisions on preventing access excluding the decisions rendered as per Article 8 of the Law. For this reason, the content / hosting provider must be consulted for removing the content from publication.
- Blocking Access to Content:
Real or legal persons, institutions and organizations claiming a violation of personal right due to a content on the Internet may request blocking access to the content by applying directly to the Criminal Court of Peace, as well as requesting the content to be removed from the publication with the warning method if they cannot reach the content provider.
The request of the person whose personality is violated is answered by the content and/or hosting provider within twenty-four hours at the latest. Therefore, in the event that the applications made to the content and hosting providers are unsuccessful, you should apply to the nearest Criminal Court of Peace on the grounds that your personal rights are violated and you must request blocking access to the URL / Domain Name / IP address(es) you specify in your petition in accordance with the Law No. 5651.
The Criminal Court of Peace decides on the application made under Article 9 of Law no. 5651 without a trial within twenty-four hours at the latest. The Court decides to prevent access to the URL / Domain Name / IP address if it detects violation of personal right.
In accordance with the protocol signed between ESB and the Ministry of Justice, integration with UYAP has been achieved. Access blocking decisions are sent to ESB by judgeships via UYAP. The decisions sent by fax and e-mail to ESB, are not processed.
If the judgeship has stipulated the requirement for finalization to implement the decision, no action is taken by ESB until receiving finalization statement about the decision. However, despite the stipulate for finalization, the decisions delivered to the ESB by judgeship for implementation, are implemented without waiting for finalization statement. If there is no contrary provision about decisions on prevention of access coming to ESB, the condition of finalization is not sought. However, if objection authority decided to remove the decision made by the judgeship, the blocked addresses are re-opened.
Executing the decisions on prevention of access excluding the decisions rendered as per Article 8 of the Law is Access Providers Association's field of task. In this context, ESB sends decisions on prevention of access by public authorities authorized by special laws to the access providers for implementation.
ESB does not take action on the decision to prevent access granted under Article 8 of Law No. 5651. In case a decision to prevent access granted by the judgeship pursuant to Article 8 of Law No. 5651 is sent to ESB, this decision is sent to ICTA (Bilgi Teknolojileri ve İletişim Kurumu), which should be the interlocutor. Contents related to the crimes in article 8 of Law No. 5651 can be reported from www.ihbarweb.org.tr to Information and Communication Technologies Authority Internet Information Notification Center.
With respect to URL addresses starting with "http", it is possible to block access to content published on the Internet. However, Internet sites such as "facebook.com", "youtube.com", and "twitter.com", which are mostly used for creating accounts, are not technically possible to block access to the URL addresses of these sites since they use the "https" protocol. Incoming decisions in this direction are forwarded to the access providers by the ESB and judgeships are informed that access blocking is not technically feasible.
Under the Law No. 5651, ESB executes only the decisions on prevention of access to URL / Domain Name / IP addresses. Within this framework, it is not possible to fulfill the decisions by ESB to close the e-mail address or to prevent access to the e-mail address.
In order for ESB to implement the access blocking decisions which made by judgeships, URL / Domain Name / IP address to be blocked must be explicitly take part in the provision part.
The URL address refers to the content that is subject to the violation of personal right in the web browser and it is exemplified “http://www.abcd.com/abcdefgh.htm”. ESB does not take any action to the decisions given like "Blocking access to content about the person who made a request" etc. without specifying an URL address. The domain name is illustrated as "www.abcd.com".
The IP address is the address given by Internet Protocol standards that devices connected to a particular network use to recognize each other, communicate with each other and send data to each other.
Pursuant to Article 9/9 of Law No. 5651; In case of the contents which where is decided to be blocked to access is also published on other Internet addresses, the person whose right has been violated or his/her attorney with wet signed or secure electronic signature petition can apply to ESB.
Upon this application, in case of the publications in the addresses requested to be blocked to access are the same as the content that is decided to be blocked to access in the judgeship decision, the judgeship decision is also applied to these addresses.
Refutation and correction decisions sent by the concerned persons or judgeship, cannot be applied because they do not fall within the scope of duty of ESB. Interlocutor is informed about this issue.
TWITTER:
In order to enable users to report their complaints on the “twitter.com” website, https://support.twitter.com/ link is used, by following the steps related to the complaint of relevant article from the menu given in this link, resolution of the complaint can be provided under the supervision of commercial companies. It was detected in the research conducted on open sources that the e-mail address of the commercial company that operates the twitter.com website, are twi18nlp@twitter.com and domains@twitter.com. As a result of the application to here, the relevant contents are evaluated by the authorities.
FACEBOOK:
In order to enable users to report their complaints on the "facebook.com" website, https://www.facebook.com/help link is used, by following the steps related to the complaint of relevant article from the menu given in this link, resolution of the complaint can be provided under the supervision of commercial companies. It was detected in the research conducted on open sources that the e-mail address of the commercial company that operates the "facebook.com” website is domain@fb.com.
YOUTUBE:
In order to enable users to report their complaints on the "youtube.com" website, https://support.google.com/youtube link is used, by following the steps related to the complaint of relevant article from the menu given in this link, resolution of the complaint can be provided under the supervision of commercial companies. It was detected in the research conducted on open sources that the e-mail address of the commercial company that operates the “youtube.com” website is support@youtube.com.
ESB fulfills the decisions regarding prevention of access excluding the decisions rendered as per Article 8 of the Law, either before the establishment of ESB or after the date of entry into force of Law No. 5651
Pursuant to Article 6/A of Law No. 5651; ESB has been established to ensure that access prevention decisions are implemented. Therefore, no individual application can be made to the ESB without the decision to block access.
People whose privacy of their private life is violated due to broadcasting content on the Internet, can apply directly to the ICTA (Bilgi Teknolojileri ve İletişim Kurumu) and request the implementation of the prevention of access to content. Upon this request, access blocking decision that is made by ICTA (Bilgi Teknolojileri ve İletişim Kurumu) as a precaution, is sent to ESB. The ICTA should submit the injunction of claimant to approval of the judge within 24 hours. Otherwise, the precautionary decision will be automatically rescinded and address that were blocked to access, will be opened again.
Blocking access precaution is being limited with blocking access to relevant addresses from Turkey, and it is possible to access these addresses in cases such as VPN settings have been changed.
There are many reasons why access to URL/Domain Name addresses that are decided to be blocked and are sent to ESB. Firstly; The URL/Domain Name of the available content should be checked to see if the URL/Domain Name address in the judgeship decision is exactly the same. Because it is frequently encountered situation for the same content to be published in different URL / Domain Name addresses. If you find that the URL/Domain Name address is not different, you should clear cookie and cache of your device.
However, if it is still accessible; If you sent an e-mail to "vatandas@esb.org.tr" address belongs to ESB by adding the screenshot including the URL/Domain Name address of the content, IP address of the device used and the name of your Internet service provider, information will be given as a result of necessary examination.
ESB has no duty and authority to remove URL/Domain Name addresses which have a decision to block access, from search engines.
The content must be unpublished so that information about the blocked content does not appear in the search engine. The content/hosting provider must also be applied to remove relevant content from publishing. As the results from search engine queries are again caching by search engines, result can be obtained by waiting for the period of clearing the cache of search engines, even if these contents are removed.

Clear Cookie and Cache
If there is a problem with the browser you are using or the page you are viewing, first try clearing the browser's cache. If the problem persists after clearing the cache, clear the browser's cookies.
The instructions for clearing the cache and cookies may be different for each browser and each version. Below are the steps required for various frequently used browsers and versions. To start, select the browser you are using:
Microsoft Internet Explorer
To learn "Tip Version", Click "Help" in Internet Explorer and then click "About Internet Explorer." If you cannot see the "Help" menu, press the "Alt" button to display the menus.
1)Cache. First, clean the browser cache of the version you are using.
Internet Explorer 7.x
Click the Tools Menu. If you cannot see the menu, press the Alt button on your keyboard to display the menus.
Select Delete Browsing History.
Click the Delete files button.
In the confirmation window, click the Yes button.
Click the Close button.
Note: It may take several minutes for the cache history to be deleted.
Internet Explorer 6.x
Click the Tools Menu.
Select Internet Options.
Click the General tab.
Click the Delete files button.
Click OK in the confirmation window.
Click OK to close the 'Internet Options' window.

2) Cookies. If clearing the cache does not resolve the issue, you may also need to clear browser cookies.
Important! Deleting browser cookies may solve the problem but it also deletes your saved settings for sites you've previously visited.
